Who we are
- We are Ridewise Pro Limited (“Ridewise”), a UK Registered Limited company number 16343681 whose address is Florin Studios, Florin Court, 6-9 Charterhouse Square, London EC1M 6EY.
- Ridewise reserves the right to change the policy at any time, so please check back regularly to keep informed of any updates.
What we do
- The principal activity of Ridewise is the delivery of advanced motorcycle rider training for licensed motorcycle riders.
The contract
- A contract is formed between you and Ridewise when you place an order, whereupon you will receive an e-mail from Ridewise acknowledging that we have received and confirmed your order, along with joining instructions.
- By booking a Course through the website and ticketing system you warrant that you are legally capable of entering into binding contracts.
- If you do not receive the confirmation email, or you are unsure about any matter regarding your booking please email the training team at bookings@ridewise.pro
- Ridewise may revise these Terms and Conditions at any time by amending this page or the relevant document. Please check this website from time to time to take notice of any changes made, as they are binding.
Booking on behalf of someone else
- If you are booking on behalf of someone else, you must ensure that such person(s) comply with the requirements for joining a Ridewise Course. You also undertake to us that such person(s) will comply with all requirements set out in this agreement. If they or their vehicles do not comply with the terms of this agreement, then Ridewise shall be entitled to prevent their participation in the Course or require them to leave the Course once it has commenced.
- You will be responsible for bearing any cost incurred as a result of cancellation or the relevant person’s non-attendance at the Course. We are unable to provide refunds other than to those customers who have booked directly with us.
- If you have any doubt that anyone for whom you are booking a Course is or may not be able to comply with any of the terms of this agreement, please do not proceed with that booking and advise such person(s) to book directly.
Course pricing
- The price of Course bookings will be as quoted on the site from time to time, except in cases of obvious error. These prices include VAT. Prices may change at any time, but changes will not affect orders in respect of which Ridewise has already sent a confirmation email.
- Payment must be by credit or debit card. We accept payment using Visa, MasterCard, Switch. The only currency we currently accept is Pounds Sterling (GBP).
Availability
- All Courses are subject to availability. Please check the details of your Course booking set out in the confirmation email as mistakes cannot always be rectified.
Your ticket
- Your Course ticket is and remains at all times the property of Ridewise. The ticketholder shall not: (a) use, offer or apply the ticket as a prize or in any other manner in a lottery or competition or for any other promotional, advertising or commercial purpose; or (b) sell, resell, donate, transfer or in any way dispose of the ticket to any person/entity via any media (including without limitation on the internet) for the purpose of commercial gain or otherwise.
- The ticket shall be void if purchased or obtained in contravention of condition 1 above or from any person/entity who is not an authorised agent of Ridewise, and the ticketholder may be refused course participation as a result, without prejudice to any other rights or remedies that may be available to Ridewise.
- A Ridewise ticket is required to gain admission to a course or event. Receipts are not acceptable. Any attempt to present any unofficial or counterfeit ticket may lead to refusal of admission and possible prosecution.
- Please keep your ticket safe.
- Your ticket relates to a Rider Training Course.
- The date of the Course may be subject to change by Ridewise, in which circumstances ticketholders agree that their tickets will be valid for the Course as changed, and no refunds or exchanges will be available.
- Your ticket is non-refundable and non-transferable, but you may be entitled to a refund or exchange (at Ridewise’s election) if the Course is cancelled in its entirety prior to the commencement of the Course for reason(s) that are within the reasonable control of Ridewise.
- If the Course is cancelled or otherwise changed for reasons that are beyond Ridewise’s reasonable control including, but without limitation, compliance with any law or governmental order, rule or restrictions, adverse weather, fire, disease, war or terrorist activity, commotion, acts of God, strikes or other industrial action, breakdown of plant, machinery or any failure of gas, water service, electricity or similar supplies, then Ridewise shall in such circumstances have no liability to the ticketholder for any loss or damage suffered as a result of such cancellation or other change.
Cancellations
- Cancellation by Ridewise
Ridewise may have to cancel a Course due to events beyond its control, for example adverse weather conditions. This will usually be in the interests of safety. Where a Course is cancelled in its entirety for such reasons, Ridewise will endeavour to notify participants of the cancellation although Ridewise cannot guarantee that participants will be informed of such cancellation before the date of the event. Where a Course is cancelled in its entirety for such reasons Ridewise are unable to re-imburse third party costs incurred due to the cancellation but will endeavour to offer either (a) a full credit towards a place on an alternative, later track day (subject to availability) up to the face value of the existing booking or, (b) if Ridewise cannot provide an alternative date, a full refund will be made.
- If Ridewise cancel a Course for reasons other than events beyond its control, a full credit, transfer or refund will be offered. In order to claim any refund, please apply in writing to Ridewise’s address set out at the start of these terms and conditions, stating clearly the Course day/date to which the application relates. For accounting purposes any applications for refunds must be received within 28 days from the date of the cancelled Course.
Cancellation by you
- If you are unable to attend the Course, please contact the Ridewise team as soon as possible, by sending an email to bookings@ridewise.com. In these circumstances, provided Ridewise are notified no later than 28 days prior to the originally booked Course date, Ridewise will endeavour to reschedule your booking. This must be used within a three-month period from the date of cancellation. The Ridewise Course you are booking does not need to take place within three months; you must simply have made your booking. For example, if you cancel your Course on the 1st of January, you must have booked an alternative Course by the 1st of April. Any credits not used within the 3-month period automatically expire. It is your responsibility to redeem the credit in time.
- You may also let us know of a name change and we will action this at no fee, albeit this person will be booked according to the “Booking on behalf someone else” process.
- For the avoidance of doubt Ridewise.pro do not offer refunds.
- Any amendments to Course bookings must be requested in writing, which includes writing to us at bookings@ridewise.pro, stating clearly the Course to which the amendment relates.
Variations
- Ridewise may vary the format and / or timetable of a Course if required. Participants will be notified of any such change as soon as possible, which may include during the Course itself.
- By booking on a Ridewise Course you confirm that Ridewise may provide your name and contact details to any partner listed for the purposes of customer verification and communications in relation to the event.
Acknowledgement of Risk
- Motorcycles riding can be dangerous and can involve injury or death. Despite Ridewise taking all reasonable precautions, accidents can happen. By attending a Course, you acknowledge this and confirm that you are aware of the nature of the activity and attend the Course at your own risk.
- Ticketholders acknowledge that they may be exposed to the risk of physical harm due to the nature of the Course. Ridewise will not be liable for any injury, loss or damage to you or your property except to the extent that any such injury, loss or damage is caused by the negligence of Ridewise, or its team members. Without prejudice to the foregoing, Ridewise excludes to the maximum extent permitted by law any liability for such injury, loss or damage.
- Ridewise may refuse access to, and eject from, its Courses any persons who are acting against the interests of safety and/or whose behaviour is likely to cause damage, nuisance or injury.
- Neither Ridewise or any of its team are responsible for any loss, damage or injury to persons or of property caused or sustained by you as result of attendance at a Ridewise Course, save for liability for death or personal injury arising from Ridewise’s negligence or for fraudulent misrepresentation.
Jurisdiction and Applicable Law
- The English courts will have exclusive jurisdiction over any dispute or claim arising from or related to these terms and conditions (and the documents referred to in them) and/or attendance at a Course. These terms and conditions (and the documents referred to in them) are governed by English law.
Photography and Production of Coverage
- Other than taking still photographs for personal, non-commercial and non-promotional use, no participants are permitted to produce or broadcast any audio, visual (still and/or moving) and/or audio-visual coverage of the Course without obtaining Ridewise’s prior written consent. Ridewise shall be entitled to charge a reasonable fee for the production of such coverage.
- Where Ridewise provides its consent to the production of coverage (a) any and all on-board video equipment carried in or on motorcycles must be safely and securely installed in accordance with any applicable governing body regulations; and (b) if the person making the request is a journalist, photographer and/or cameraman, such person must complete a media accreditation form supplied by Ridewise, accompanied by a letter or other written communication from the journalist’s, photographer’s or cameraman’s relevant publication or company.
Course attendee Requirements
- All Course participants must hold one of the following licences and comply with the relevant regulations in order to take part in a course: Road licence must be a full unrestricted, driving licence issued by the DVLA (or the equivalent foreign licensing authority in the country of residence and be 18 years or above) with the appropriate category clearly indicated.
Your motorcycle
- It is your responsibility to ensure that your motorcycle is operational and is compliant with any relevant laws. Ridewise expects you to make sure the motorcycle is in good condition, and has a valid MOT, insurance and that Vehicle Excise Duty (VED) is paid and current. If your vehicle is not fully operational, Ridewise assumes no responsibility and will not issue any refunds or allow date transfers for the event. If your vehicle experiences mechanical problems that prevent or limit participation, a refund or transfer will not be provided.
Personal Protective Equipment (PPE) requirements
- All Course participants must wear a suitable, correctly fitting safety helmet and appropriate personal protective equipment.
Accident Damage and Insurance
- Whilst accidents on Ridewise Courses are rare, by using your own motorcycle on the road you are required to be insured, and you participate at your own risk.
Briefing
- Course briefing will take place prior to any road-riding activity. All riders must complete this briefing and adhere to the rules stipulated in it.
- Participants must not act or ride recklessly, dangerously or in an intimidating fashion. If in Ridewise’s opinion you are behaving, riding, or acting dangerously, recklessly or behaving in an intimidating fashion you may be removed from further participation in the Course and/or ejected from the Course, at Ridewise’s discretion.
- No participant shall consume or be under the influence of alcohol at any time during the Course.
- No participant shall be under the influence of drugs or medication (prescribed or otherwise) or have any pre-existing medical condition that will adversely affect his or her performance during the Course.
- Participants must listen to all briefings and safety instructions throughout the Course.
- Any kind of riding which is considered by Ridewise to be a nuisance or dangerous is not permitted.
- Abusive or inappropriate language (of any form) will not be tolerated.
Photographic equipment and filming
- The use of photographic equipment is allowed for private non-commercial purposes only. Camera equipment must be suitable mounted and secured with secondary tethers for safety purposes. Externally or internally mounted helmet cameras are not permitted.
- Any other recording or transmission of audio, visual or audio-visual material or any information or data by any method in any media relating to the Course or any part of it is prohibited. The ticketholder hereby assigns to Ridewise (by way of present assignment of future rights) the copyright in any audio, visual or audio-visual materials produced by the ticketholder at the Course.
- Ridewise may record or make audio, visual or audio-visual recordings of the Course and the ticketholder hereby consents to the use of his or her likeness, image and/or voice within such recordings free of charge. Cameras are in use on Courses, and you agree that Ridewise may use or pass on to any relevant authority any recordings for use in any legal proceedings.
Legal jurisdiction
- These terms and conditions are governed by the laws of England and subject to the exclusive jurisdiction of the English courts.
